This statement reflects the standards we strive to uphold in good faith. It is a statement of intent only and does not constitute a warranty, guarantee, or service-level commitment, nor does it create any contractual obligation. Nothing in this section limits, modifies, or overrides the user responsibilities (including your responsibility to back up your data) in Section 3 or the disclaimers and limitations of liability in Section 4, which continue to apply in full.

1. Acceptance of Terms

By accessing or using snapbrief (the "Service"), operated by Euclidity SL, a company registered in Spain ("we," "us," or "our"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree with these Terms, you may not use the Service.

2. Service Description

Snapbrief is a SaaS platform designed for site surveyors to upload photos, create site reports, and securely share them with authorized parties. All data is hosted and processed exclusively within the European Union (EU).

3. User Responsibilities

You are solely responsible for:

  • Ensuring the accuracy, legality, and non-infringement of any content (e.g., photos, reports) you upload or share.
  • Backing up your data. We are not responsible for data loss due to user actions, technical failures, or any other cause.
  • Securing your account credentials and notifying us immediately of any unauthorized access.
  • Complying with all applicable laws, including but not limited to EU and Spanish regulations.

4. Disclaimers and Limitations of Liability

4.1 No Warranty

The Service is provided on an "as-is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to:

  • Merchantability or fitness for a particular purpose.
  • Non-infringement of third-party rights.
  • Accuracy, reliability, or availability of the Service.

4.2 Limitation of Liability

In no event shall Euclidity SL, its directors, employees, or agents be liable for:

  • Any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, data, or business interruption.
  • Any data loss or corruption, whether caused by user error, technical failure, or any other reason.
  • Any third-party actions, including but not limited to the use or sharing of reports by authorized or unauthorized users.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the event giving rise to the claim.

5. Data Ownership and Deletion

  • You retain full ownership of all data you upload or create using the Service.
  • You may delete your account and all associated data at any time via your account settings. We will permanently delete your data within 30 days of your request, in accordance with GDPR Article 17 (Right to Erasure).

6. Termination

  • By You: You may terminate your account at any time by deleting it in your account settings.
  • By Us: We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to violations of these Terms.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these Terms shall be resolved exclusively in the courts of Spain.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after such changes constitutes acceptance of the new Terms. We will notify you of any material changes via email or a notice in the Service.
